1. Agreement to Terms

By accessing or using ClearedCareers ("the Platform", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Platform.

We reserve the right to modify these Terms at any time. Your continued use of the Platform after any changes constitutes acceptance of the modified Terms.

2. Account Registration and Security

2.1 Account Creation

To use certain features of the Platform, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Maintain the security of your password
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access

2.2 Account Types

The Platform supports multiple account types:

  • Job Seekers/Candidates: Security-cleared professionals seeking employment
  • Employers: Companies and organizations seeking cleared talent
  • Recruiters: Authorized representatives of employer accounts
  • Administrators: ClearedCareers staff with platform management access

3. Security and Abuse Prevention

3.1 IP Address Tracking and Monitoring

To protect the Platform and our users, we monitor and log IP address activity for:

  • Security auditing and abuse detection
  • Preventing unauthorized access and fraudulent activity
  • Investigating suspicious behavior and potential violations
  • Marketing insights and platform analytics
  • Compliance with legal and regulatory requirements

We track IP addresses, user agents, request paths, event types, and associated metadata for all Platform activity, including but not limited to:

  • Login attempts (successful and failed)
  • User registrations
  • Job searches and views
  • Page access and navigation
  • API requests and interactions

3.2 IP Address Blocking

We reserve the right to block IP addresses that:

  • Exhibit abusive, fraudulent, or malicious behavior
  • Attempt unauthorized access to the Platform
  • Violate these Terms of Service
  • Engage in scraping, data harvesting, or automated abuse
  • Pose a security threat to the Platform or other users

Blocked IP addresses will be denied access to sensitive Platform features, including but not limited to login, registration, and job search functionality. Blocking decisions are made at our sole discretion and may be permanent or temporary.

3.3 Prohibited Activities

You agree not to:

  • Use automated systems, bots, or scrapers to access the Platform
  • Attempt to circumvent IP blocking or security measures
  • Share or sell access to your account
  • Impersonate other users or entities
  • Interfere with or disrupt the Platform's security or functionality
  • Attempt to gain unauthorized access to any part of the Platform
  • Use the Platform for any illegal or unauthorized purpose

4. User Conduct and Responsibilities

4.1 Job Seekers

Job seekers agree to provide accurate information about their clearance level, skills, and qualifications. You are responsible for maintaining the accuracy of your profile and resume.

4.2 Employers

Employers agree to post only legitimate job openings that require security clearances. You are responsible for the accuracy of job postings and for responding to qualified candidates in a timely manner.

4.3 Content Standards

All content posted on the Platform must:

  • Be accurate and truthful
  • Comply with applicable laws and regulations
  • Not infringe on intellectual property rights
  • Not contain discriminatory, harassing, or offensive material
  • Not include false or misleading information about security clearances

5. Privacy and Data Collection

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Platform, you consent to the collection and use of information as described in our Privacy Policy, including:

  • IP address tracking and activity logging
  • User authentication and session data
  • Profile and resume information
  • Job search and application data
  • Communication and messaging data

6. Intellectual Property

The Platform and its content, including but not limited to text, graphics, logos, software, and design, are the property of ClearedCareers or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You retain ownership of content you post on the Platform, but by posting content, you grant ClearedCareers a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content in connection with the Platform's services.

7. Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for:

  • Violation of these Terms of Service
  • Fraudulent, abusive, or illegal activity
  • Security threats or unauthorized access attempts
  • Violation of applicable laws or regulations
  • At our sole discretion for any reason

Upon termination, your right to use the Platform will immediately cease. We may delete your account and associated data, subject to our data retention policies and legal obligations.

8. Disclaimers and Limitation of Liability

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

ClearedCareers does not guarantee job placements, candidate qualifications, or employer hiring decisions. We are not responsible for the accuracy of job postings, candidate profiles, or the outcome of any job application or hiring process.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLEAREDCAREERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM.

9. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
